Welcome to Gold Standard Buys. These Terms of Service (the "Terms") govern your access to and use of the website located at goldstandardbuys.com (the "Site") and the estate jewelry buying, appraisal, and consultation services offered by Gold Standard Buys (collectively, the "Services").
By accessing the Site, requesting a quote, or otherwise engaging our Services, you agree to be bound by these Terms. If you do not agree, please do not use the Site or Services.
1. Acceptance of Terms
These Terms constitute a legally binding agreement between you ("you," "your," or "Client") and Gold Standard Buys ("we," "us," "our," or "Company"), a business operating in Laguna Hills, California. By using the Site or Services, you represent that you are at least 18 years of age and have the legal capacity to enter into this agreement.
We reserve the right to modify these Terms at any time. Updates will be posted on this page with a revised effective date. Your continued use of the Services after changes are posted constitutes acceptance of the revised Terms.
2. Description of Services
Gold Standard Buys specializes in the purchase, appraisal, and consultation of estate jewelry, fine jewelry, diamonds, gold, and other precious items. Our Services may include, but are not limited to:
• Preliminary quotes for jewelry and precious items submitted online, by phone, or in person.
• In-person and remote consultations regarding the value of your items.
• Professional appraisals for insurance, estate, or resale purposes.
• Purchase of qualifying items at agreed-upon prices following physical inspection.
All Services are provided subject to availability and to the terms outlined in this agreement.
3. Quotes and Offers
3.1 Preliminary Quotes
Any quote provided based on photographs, descriptions, or verbal information is preliminary and non-binding. Such quotes are estimates only and are intended to provide a general range of value. Final offers are determined exclusively after physical inspection of the item by our staff.
3.2 Final Offers
After physical inspection, we will provide a final written offer. This offer is valid for fourteen (14) calendar days from the date issued, unless otherwise stated in writing. Final offers reflect current market conditions and may differ from any preliminary quote.
3.3 Market Fluctuations
Prices for gold, diamonds, gemstones, and other precious materials fluctuate based on global market conditions. We make no representation that any offer or quote will remain consistent with market prices at any future date.
4. Shipping and Insurance
4.1 Client Responsibility
If you elect to ship items to us for evaluation or sale, you are solely responsible for arranging shipment and for ensuring adequate insurance coverage during transit. Gold Standard Buys is not liable for any loss, theft, or damage that occurs before the items are received and confirmed in our possession.
4.2 Recommended Carriers
We recommend using fully insured, trackable shipping services such as USPS Registered Mail with declared value, FedEx with signature confirmation, or UPS with declared value insurance. Upon request, we may provide guidance on appropriate shipping practices.
4.3 Return Shipping
If a transaction does not proceed, items will be returned to you at your expense via insured carrier, unless otherwise agreed in writing.
5. Payment Terms
Payment for purchased items will be made in U.S. dollars by check, bank wire transfer, ACH, or another mutually agreed method. Payment will be issued only after:
• Both parties have executed a written purchase agreement, and
• The item has been physically received and verified by Gold Standard Buys.
Wire transfers and ACH payments are typically processed within three (3) business days of agreement execution. Check payments are issued within five (5) business days. We reserve the right to delay payment if additional verification of identity or ownership is required.
6. Title, Ownership, and Identification
By selling an item to Gold Standard Buys, you represent and warrant that:
• You are the rightful owner of the item or are duly authorized to sell it.
• The item is free of any liens, security interests, or third-party claims.
• The item is not stolen, lost, or otherwise the subject of any criminal investigation.
We may require valid government-issued photo identification and proof of ownership prior to completing any purchase, in accordance with applicable federal, state, and local laws, including California Business and Professions Code requirements for secondhand dealers.
7. Returns, Cancellations, and Holding Periods
7.1 Before Final Agreement
You may withdraw your item from consideration at any time before a final purchase agreement is signed. The item will be returned to you at your expense.
7.2 After Final Agreement
Once a final purchase agreement is signed and payment has been issued, the sale is final. We do not offer returns or exchanges on completed purchases except as required by applicable law.
7.3 Statutory Holding Periods
Where required by California law, purchased items may be held for a statutory period before being resold or altered. This holding period is in addition to any internal review period we maintain.
8. Appraisals and Valuations
Appraisals provided by Gold Standard Buys reflect our professional opinion of value based on current market conditions, the condition of the item, and other relevant factors. Appraisals are not guarantees of resale value, insurance reimbursement, or future market price. Written appraisals are valid for the date issued and may not reflect value at any later date.
9. Intellectual Property
All content on the Site, including text, graphics, logos, images, photographs, videos, and software, is the property of Gold Standard Buys or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws.
You may not copy, reproduce, distribute, modify, transmit, or create derivative works from any Site content without our prior written consent. The Gold Standard Buys name, logo, and related marks are trademarks of the Company.
10. User Conduct
When using the Site or Services, you agree not to:
• Provide false, misleading, or fraudulent information about yourself or about items submitted for evaluation.
• Attempt to gain unauthorized access to any portion of the Site or its underlying systems.
• Use the Site or Services for any unlawful purpose or in violation of any applicable law.
• Interfere with or disrupt the operation of the Site, including by introducing viruses, malware, or other harmful code.
• Harass, abuse, or threaten our employees, contractors, or other clients.
11. Disclaimers
THE SITE AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, GOLD STANDARD BUYS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses. We make no warranty regarding the accuracy, completeness, or reliability of any content on the Site, including pricing information, market data, or educational material.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GOLD STANDARD BUYS, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR LOST DATA, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE OR SERVICES.
OUR TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT WE PAID OR WERE OBLIGATED TO PAY YOU IN THE SPECIFIC TRANSACTION GIVING RISE TO THE CLAIM.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you in full.
13. Indemnification
You agree to indemnify, defend, and hold harmless Gold Standard Buys and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your breach of these Terms; (b) your violation of any law or third-party right; or (c) any item you submit to us that is later determined to be stolen, misrepresented, or otherwise the subject of a third-party claim.
14. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any dispute arising out of or related to these Terms or the Services shall be resolved exclusively in the state or federal courts located in Orange County, California, and you consent to the personal jurisdiction of such courts.
Before initiating any formal legal action, you agree to first contact us at the address below and attempt in good faith to resolve the dispute informally for a period of thirty (30) days.
15. Severability
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.
16. Entire Agreement
These Terms, together with our Privacy Policy and any written purchase agreement signed in connection with a specific transaction, constitute the entire agreement between you and Gold Standard Buys regarding the Services and supersede any prior agreements or communications.
